What to Expect Before Your Charter

Please review the following important information prior to your reservation. This is a brief summary of key policies. Full details are provided below in our complete Terms & Conditions.

Reservation & Payment: A deposit secures your booking. The remaining balance must be paid on the day of your charter prior to departing.
Arrival Time: Please arrive 15–30 minutes early to allow time for check-in and parking, as marina parking can be limited and busy on weekends.
Check-In: The primary renter must present a valid government-issued photo ID that matches the reservation.
Safety Course Requirement: The primary renter must complete a Florida Boating Safety Course if they were born on or after January 1, 1988, as required by Florida law.
Waiver:
Primary Renter must sign a liability waiver before boarding.
Security Deposit: Some vessels require a refundable security deposit, returned after the charter once the vessel is inspected provided no damages, excessive cleaning, or policy violations occur.
Jet Ski Requirements: Any individual operating a jet ski on or after January 1, 1988 must follow Florida boating safety regulations, which requires completing a temporary safety course.
Boarding & Accessibility: Boarding may involve stepping onto the vessel and navigating steps. If anyone in your group has mobility limitations, please notify us in advance so we can recommend the most suitable vessel.
Guest Capacity: Each vessel has a maximum capacity of 13 guests, in accordance with U.S. Coast Guard regulations. Larger groups may require reserving multiple vessels.

By reserving a charter, submitting payment, or participating in any experience arranged through Topline Yacht & Boat Rentals LLC (“Topline”), you acknowledge and agree to the following Terms & Conditions.
Our policies are designed to ensure a seamless, elevated, and professionally managed experience while maintaining safety and fairness for all parties.

1. Reservation & Payment
The guest making the reservation (“Charterer”) is responsible for the booking and all members of their party.
The name of the Charterer must match the name on the reservation and the payment method used. A valid government-issued photo ID will be required upon arrival for verification.
Failure to provide matching identification may result in cancellation without refund.
A reservation deposit is required to secure the selected vessel and date. This deposit is applied toward the total charter price.
The remaining vessel balance is due on the day of the charter unless otherwise specified.
Captain fees, crew gratuity, marina fees, fuel surcharges, and optional add-ons are paid separately where applicable.
Reservations are considered confirmed once payment is processed and confirmation has been issued by us.

2. Vessel Use & Captain Selection
In accordance with U.S. Coast Guard regulations, Charterer is required to complete a Captain Selection Process. Charterer will be provided with a list of independently licensed captains to choose from. Captains are paid separately per bareboat agreement.
Captains operate independently and are responsible for navigation, operation of the vessel, and onboard safety throughout the charter.
For safety reasons, the Captain has final authority regarding vessel operations, route adjustments, and onboard decisions.

3. Required Documentation
Prior to departure:
Primary Renter must complete waiver
A valid government-issued photo ID is required
Any remaining balances must be paid
Applicable security deposits must be submitted
Failure to complete required documentation may result in cancellation without refund.

4. Jet Ski Add-Ons
Jet ski operation must comply with Florida boating laws.
Guest born after January 1, 1988 must obtain a temporary boating safety certificate prior to operating a jet ski.
A $200 refundable security deposit per jet ski is required and paid directly to the instructor or provider. Deposits are refunded if no damage occurs.
If a promotional or included jet ski becomes unavailable due to mechanical or safety concerns, a courtesy credit may be issued at management’s discretion.
Guests who do not meet legal certification requirements will not be permitted to operate jet skis. In such cases, refunds or credits will not apply.

Yacht + Complimentary jet ski Experience
Select charters may include a complimentary jet ski as part of a bundled yacht experience. The yacht charter and jet ski are offered together as one package and are not sold or priced individually.
The jet ski is a promotional inclusion and carries no separate cash value. No refunds, credits, or price adjustments will be issued if it is not used.
Late arrivals or schedule delays may result in limited or unavailable Jet ski time without compensation.
Jet ski operation may be restricted or unavailable due to weather, safety conditions, local regulations, or the captain’s discretion. If this occurs, the charter will continue as scheduled without refund or reduction in price.

5. Charter Experience Guidelines
To maintain a refined and enjoyable atmosphere onboard:
Please arrive 15–30 minutes prior to departure
Charter time begins at the reserved departure time
Late arrival does not extend charter duration
Guests may bring food and beverages (alcohol permitted for guests 21+).

The following are not permitted onboard:
Red wine
Hookah
Weapons
Illegal substances
Smoking is allowed only in designated areas.
Topline reserves the right to terminate a charter without refund in cases of unsafe, unlawful, or disruptive behavior.

6. Security Deposits, Damage & Cleaning
The Charterer accepts responsibility for the vessel during the reserved period.
Damage fees ranging from $200–$1,000 may apply depending on severity.
Excessive cleaning fees ranging from $150–$450 may be assessed if the vessel is returned in unsatisfactory condition.
Security deposits are typically released after post-charter inspection.
Topline is not responsible for lost, stolen, or damaged personal belongings.

7. Rescheduling & Cancellation Policy
We understand that plans sometimes change. Since your charter date is reserved exclusively for your party, the following rescheduling and cancellation policies apply.
Requests must be submitted in advance and are subject to availability. A rescheduling fee may apply.
Cancellations
More than 60 days prior:
50% refund or 50% credit (processing fees apply)
14–21 days prior:
100% credit issued, no refund
7 days or less:
No refund
72 hours or less:
No refund and no credit
Same-day and last-minute reservations are final.
Approved refunds, when applicable, are processed within 2–5 business days and may be subject to administrative or processing fees.
Management reserves discretion to review exceptional circumstances when appropriate.
All cancellation requests must be submitted in writing via email.

8. Weather Policy

Charters operate rain or shine.
Rescheduling at no charge is permitted only in the event of verified hazardous marine conditions, including:
Named storms within 5 miles of Miami
Sustained winds exceeding 30 mph
Waves exceeding 3 feet
Official NOAA Small Craft Advisories
Weather determinations are made near departure time based on marine conditions rather than general forecasts.
Once a charter has commenced, it is considered fulfilled.

10. Vessel Substitution Policy
In rare circumstances, a reserved yacht may become unavailable due to mechanical issues, safety concerns, regulatory restrictions, or other unforeseen events beyond the company’s control.
If this occurs, the company will make reasonable efforts to provide a replacement vessel of similar size, style, and value for the scheduled charter time.
If a comparable vessel is not available, the client may be offered alternative vessel options, a rescheduled charter date, or a refund of the amount paid, at the company’s discretion.
Vessel substitutions may occur without prior notice if necessary to ensure guest safety or operational compliance.
The company is not responsible for additional expenses, travel costs, or related damages resulting from a vessel change or unavailability.
Acceptance of the replacement vessel will constitute fulfillment of the reservation agreement.

11. Dispute Resolution

We are committed to resolving concerns promptly and professionally.
Guests agree to contact the Company directly to allow the opportunity for resolution before initiating payment disputes or chargebacks.
Claims involving fraud, unauthorized transactions, or improper chargebacks will be formally disputed. The Company reserves the right to recover associated bank fees, administrative costs, and related damages as permitted under Florida law.
For unresolved matters, disputes shall be resolved through binding arbitration in the State of Florida, and both parties waive the right to a jury trial.

12. Assumption of Risk & Liability
Participation in boating and marine activities involves inherent risks.
By booking, the Charterer accepts responsibility for themselves and their guests and agrees to release and hold harmless Topline Yacht & Boat Rentals LLC, its owners, affiliates, and representatives from claims arising from participation in the charter experience.
Additional services such as catering, décor, entertainment, or specialty accommodations may be provided by independent vendors and remain subject to their respective terms.

13. Media & Marketing
From time to time, photos or videos may be captured during charter experiences for promotional purposes.
By participating, guests grant permission for general imagery to be used for advertising, social media, and brand materials.
Guests who prefer not to appear in marketing content may provide written notice prior to departure.

14. Pricing & Charge Authorization

Charter rates reflect vessel reservation pricing unless otherwise stated.
Final pricing may vary based on:
Vessel selection
Duration
Peak or holiday demand
Fuel usage (if applicable)
Add-ons or custom accommodations
By submitting payment, the Charterer authorizes agreed charges associated with the reservation.

15. Policy Modifications
Topline Yacht & Boat Rentals LLC reserves the right to update these Terms & Conditions at any time.
The version published on the website at the time of booking governs the reservation.

Final Acknowledgment
We are committed to delivering a polished, safe, and memorable experience on the water.
By completing your reservation, you acknowledge that you have read and accepted these Terms & Conditions in full.
